WM. H. D. FONES, C.J. This is a direct appeal of a death penalty case. Defendant was convicted of aggravated kidnapping, aggravated rape and murder in the first degree. The jury fixed his punishment at life on each of the first two offenses. After a bifurcated sentencing hearing, the jury found four aggravating circumstances and no mitigating circumstances and imposed the death penalty. The aggravating circumstances found were: (1) the murder was committed against a person less than twelve years of age and the defendant was over eighteen years of age; (2) the murder was especially heinous, atrocious or cruel in that it involved torture or depravity of mind; (3) the murder was committed for the purpose of avoiding prosecution of the defendant; and (4) the murder was committed while the defendant was engaged in committing and fleeing after committing rape and kidnapping.
